CONDITIONS OF ENTRY

 

  1. Information on how to enter and prizes form part of these Conditions of Entry. 

 

  1. Entry is only open to NSW and Tasmanian residents only. Employees as well as their immediate families of the Promoters and their agencies associated with this promotion are ineligible.

 

  1. To enter, consumers must log onto (spiritoftasmania.com.au), correctly complete the questions, enter their personal details as prompted, and submit their entry during the promotional period.

 

  1. The Promoters reserve the right to verify the validity of entries and to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these Conditions of Entry.

 

  1. There is a limit of 5 entries per person permitted.

 

  1. Promotion commences 12/01/04.  Entries close at 5pm 31/03/04.  The draw will take place at Anisimoff Davenport Solicitors, Level 4, 448 St Kilda Road, Melbourne, 3004 on 14/04/04 at 11.30am.  Winner will be notified by mail, telephone and email and their name will be published in The Australian on 20/04/04.  Judges' decision is final and no correspondence will be entered into.

 

  1. The first valid entry drawn will win the following prizes: (1) a Ford Escape XLT valued at $40,690 including registration and on road costs (but excluding comprehensive insurance); and (2) a cruise for four people to Tasmania aboard the Spirit of Tasmania, valued at up to $3,200 including 2 nights accommodation on board the ship and buffet dinner and brunch each day.  Spending money, additional meals, taxes, insurance, transport to and from departure point, transfers and all other ancillary costs are the responsibility of the winner.  Prize must be taken prior to 31 December 2004 and is subject to booking and flight availability.

 

  1. Total prize value is up to $43,890.  The Promoters accept no responsibility for any variation in the prize values.  Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.

 

  1. If the winner of the prize is under the age of 18 years, the prize will be awarded to the winner’s nominated parent or guardian.

 

  1. The Promoters may conduct such further draws at the same place as the original draw as are necessary on 30/07/04 in order to distribute the prize if unclaimed by that date.  In this event, the winner’s name will be published in The Australian on 13/08/04.

 

  1. This Promotion is not available in conjunction with any other offer made by the Promoters.

 

  1. The Promoters are not responsible for any incorrect or inaccurate information, either caused by website users or by any of the equipment or programming associated with or utilised in this competition, or by any technical error that may occur in the course of the administration of this competition.  The Promoters assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries.

 

  1. Any costs in accessing the promotional website are the entrant’s responsibility and will be dependent on the Internet service provider used.  If contact details are entered incorrectly on the website the entry shall be deemed invalid.

The Promoters shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for personal injury which is suffered or sustained, as a result of taking the prize, except for any liability which cannot be excluded by law.  It is a condition of accepting the prize that the winner (and companions) may be required to sign a legal release in a form determined by the Promoters in their absolute discretion.

 

  1. The Promoters reserve the right to request that the winner provide proof of age, identity and residency at the nominated prize delivery address.  Identification considered suitable for verification is at the absolute discretion of the Promoters.
