Sailors Loyalty Terms and Conditions (effective 1 August 2017)

  1. Definitions

    In these Terms and Conditions
Benefits

means any product or service offered by Spirit of Tasmania to the Member other than Travel Rewards.

Communications

means any correspondence from Spirit of Tasmania to Members by way of email, mail or SMS.

Member

means an individual that qualifies and registers for the Sailors Loyalty Program.

Member Booking

means any booking made by a Member.  

Member Number

means the membership number allocated by Spirit of Tasmania to a Member at the time they become a Member.

Member Profile

means the personal details of the Member which appear on the Member Webpage.

Member Webpage

means the Member only section on the Website.

Two One-way Journeys

means two one-way Spirit of Tasmania journeys where the:

(a)             Passenger requesting membership is listed as a Passenger on both bookings;

(b)             two bookings depart from opposite ports;

(c)             travel dates are within 90 days of each other; and

(d)             bookings have been made within two weeks of each other.

Passenger

means any person (including a minor) travelling on a ticket who is carried or is to be carried on a Spirit of Tasmania vessel.

Privacy Policy

means the Spirit of Tasmania's privacy policy located at https://www.spiritoftasmania.com.au/terms-and-conditions/privacy-policy as amended from time to time.

Qualified Booking

means either:

(a)             Two One-way Journeys; or

(b)             A Return Journey,

but excluding any bookings for freight travel, group bookings, or discounted or complimentary travel booked by Spirit of Tasmania for employees, suppliers and providers, including industry and trade partners.

Return Journey

means a return Spirit of Tasmania journey where the Passenger's forward and return sailing:

(a)             are made at the one time, and

(b)             have the same booking number.

Sailors Loyalty Program

means the loyalty program operated by Spirit of Tasmania providing Members with access to information, special offers, Benefits and Travel Rewards and is located at www.spiritoftasmania.com.au/loyalty-program.

Spirit of Tasmania

means TT-Line Company Pty Ltd (ABN 39 061 996 174) trading as Spirit of Tasmania.

Terms and Conditions

means the Sailors Loyalty Program Terms and Conditions.

Travel Rewards

means rewards offered by Spirit of Tasmania to the Member as a result of travel behaviours.

Website

means Spirit of Tasmania's website located at spiritoftasmania.com.au.

 

  1. Introduction

    2.1 These Terms and Conditions form the basis of the Sailors Loyalty Program and are intended to protect both the Member and Spirit of Tasmania. It is the Member's responsibility to read and understand them.

    2.2 Any other information relating to access, eligibility and entitlements of the Sailors Loyalty Program available from the Website (including in the Website terms of use or terms and conditions) or in any Communications is hereby incorporated into these Terms and Conditions. Where there is any inconsistency between these Terms and Conditions and any other information on the Website (including in the Website terms of use or terms and conditions) or in Communications, these Terms and Conditions shall prevail.

    2.3 These Terms and Conditions are effective from 1 August 2017 and may be amended by Spirit of Tasmania at any time in accordance with clause 9.

    2.4 Members of the Sailors Loyalty Program are bound by these Terms and Conditions.

  2. Acknowledgment

    3.1 In order to be a Member, you acknowledge and agree that:

    (a) you are a natural person;

    (b) you are 16 years of age or older;

    (c) the Sailors Loyalty Program is an online program only and you must register a valid email address to receive Benefits and Travel Rewards;

    (d) from time to time you will receive Communications relating to the Sailors Loyalty Program and you may "opt-out" of receiving such Communications at any time;

    (e) Spirit of Tasmania may:

       (i) use the information you provide when signing up to determine what Benefits and Travel Rewards you receive;

       (ii) monitor your use of the Website; and

       (iii) use and disclose any information and materials received from you or collected through your use of the Sailors Loyalty Program or the  Website,

    as permitted under the Privacy Policy;

    (f) unless otherwise stated, Passengers who do not qualify and sign up to the Sailors Loyalty Program are not eligible for the Benefits and Travel Rewards;

    (g) only one email address can be used per Member; and

    (h) Membership is not transferable.


    3.2 A natural person may become a Member by:

    (a) either:

       (i) accepting the email invitation in accordance with clauses 5.1; or

       (ii)entering the booking number of a Qualified Booking in accordance with clause 5.4; and

    (b) completing the registration in accordance with clause 6.


    3.3 For clarity, families or groups may only be a Member where each natural person in that family or group is eligible to be a Member.

  3. Qualified Bookings and Eligibility

    4.1 A Passenger is eligible for the Sailors Loyalty Program if they meet one of the below criteria:

    (a) they have made a Return Journey; or

    (b) they have made Two One-way Journeys and Passengers and have contacted Spirit of Tasmania via email loyalty@spiritoftasmania.com.au


    4.2 Qualified Bookings can be booked:

    (a) on the Website;

    (b) by telephone via Spirit of Tasmania's Customer Contact Centre or in person at Spirit of Tasmania's Reservation Counters; or

    (c) through an authorised travel agent.

  4. Member Invitations

    5.1 Where a Qualified Booking has been made:

    (a) on the Website, an invitation to the Sailors Loyalty Program will appear on the booking confirmation page of the Website , the Passenger will receive an invitation to join the Sailors Loyalty Program by email within 24 hours of booking, provided that the Passenger elects to receive Communications from Spirit of Tasmania during the booking process);

    (b) on a third party website, the Passenger will receive an invitation to join the Sailors Loyalty Program by email within 24 hours of finalising the payment of their booking, provided that the Passenger elects to receive Communications from Spirit of Tasmania;

    (c) through Spirit of Tasmania's Customer Contact Centre or Reservation Counter, the Passenger will receive an invitation to join the Sailors Loyalty Program by email within 24 hours of finalising the payment of their booking, provided the Passenger elects to receive Communications from Spirit of Tasmania.

    (d) at an authorised travel agent, the Passenger will receive an invitation to join the Sailors Loyalty Program by email within 24 hours of finalising the payment of their booking, provided the Passenger elects to receive Communications from Spirit of Tasmania.

    5.2 Upon receipt of the email as contemplated by clause 1, the passenger may then complete the online registration form to join the Sailors Loyalty Program.

    5.3 Where an invitation is emailed under clause 1, the email invitation will be sent to the email address of the lead Passenger as provided for in the booking.

    5.4 Passengers who make a Qualified Booking and do not receive an invitation to join the Sailors Loyalty Program on the booking confirmation page of the Website or by email within 24 hours of finalising the payment of their booking (as the case may be) may register to become a Member on the Website by entering the booking number of their Qualified Booking and their first name and last name.

  5. Membership registration

    6.1 Upon:

    (a) accepting the email invitation in accordance with clauses 5.1; or

    (b) entering the booking number of a Qualified Booking in accordance with clause 5.4,

    an individual will be assigned a Member Number and must create and verify their password before establishing a Member Profile.


    6.2 When establishing a Member Profile, current, complete and accurate information must be entered into the Website. The Member Profile will contain:

    (a) personal information including the Member's full name, date of birth, postal address, mobile, email address; and

    (b) account information, including a Member Number, password, and recent travel details


    6.3 The information provided under to the Member Webpage or otherwise in connection with the Member Profile, will be securely stored by Spirit of Tasmania and used in accordance with the Privacy Policy

    6.4 The Member must maintain and update information required for registration and maintaining their Member Profile, including any change of name, address, or other details as soon as practicable after the change.

    6.5 Changes to the Member's mailing address, mobile, password or email address can be made:

    (a) on the Member Profile; or

    (b) by calling or emailing Spirit of Tasmania's Customer Contact Centre.


    6.6 When making changes contemplated by clause 5, Members must supply their Member Number and personal information when making any  such changes.


    6.7 Notwithstanding clauses 6.5 and 6.6, where:

    (a) a Member wishes to change their name; or

    (b) as Spirit of Tasmania deems reasonably necessary,

    Spirit of Tasmania may require supporting documentation for such changes, including copies of a driver’s license or passport.


    6.8 The Member is solely responsible for maintaining the confidentiality of the Member's account information. The Member shall immediately notify Spirit of Tasmania of any:

    (a) unauthorised account activity;

    (b) unauthorised use; or

    (c) other breach of security known to the Member.


    6.9 The Member may, at any time, cancel their membership in writing by email to loyalty@spiritoftasmania.com.au. Upon receiving the request:

    (a) Spirit of Tasmania will cancel the Membership; and

    (b) all accumulated Benefits and Travel Rewards in that Member's account will be forfeited.

    Accordingly, Spirit of Tasmania recommends that Members carefully plan all cancellations to avoid unintentional loss of Benefits and Travel Rewards.


    6.10 Notwithstanding the satisfaction of the requirements outlined in clause 5, Spirit of Tasmania may, in its sole discretion, accept, reject or impose conditions on any Member application.

  1. Benefits


    7.1 Members are entitled to the following Benefits;

    (a) access to special offers and exclusive discounts on the Member Webpage;

    (b) Communications with information, competitions, special offers and exclusive discounts; and

    (c) special offer or gift on the Member's birthday.


    7.2 The Benefits appear under the 'Sailors Loyalty Program' section of the Website and are:

    (a) applicable to Member Bookings made since becoming a Member; and

    (b) based on the information on the Member's Profile;

    (c) available or redeemable during the timeframe specified on the Website.


    7.3 Terms and conditions for each Benefit are published separately on the Website and are available only at the time of promotion.


    7.4 In redeeming the Benefits, the Member acknowledges and agrees that:

    (a) Benefits may be subject to fees and separate terms and conditions, and, in giving such acknowledgment, agrees to comply with any applicable third party terms and conditions;

    (b) Spirit of Tasmania is not liable for the activities of any such third parties;

    (c) Benefits are not endorsed, approved or recommended by Spirit of Tasmania where the Benefits are provided by a third party; and

    (d) Benefits are not transferable and cannot be redeemed by non Members.

  1. Travel Rewards


    8.1 Members are entitled to receive Travel Rewards when Members book and travel with Spirit of Tasmania.


    8.2 Travel Rewards:

    (a) are based on:

       (i) the information on the Member's Profile; and are available or redeemable during the timeframe specified on the Website,

    (b) and will be emailed to the Member periodically.


    8.3 Spirit of Tasmania may, from time to time and in its sole discretion, vary the Travel Rewards.

    8.4 The Qualified Booking will not qualify for Member Benefits/ Travel Rewards.

    8.5 To ensure that your bookings contribute towards your Sailors Club rewards, please remember to log in to your member page prior to making any bookings. Alternatively, you can quote your member number at the time of booking. This step is essential for tracking and applying your rewards accurately.

  1. Modification to the Sailors Loyalty Program

    9.1 The Member acknowledges and agrees that Spirit of Tasmania may revise, replace, or amend the Sailors Loyalty Program and any Benefits and Travel Rewards available thereunder from time to time.

    9.2 Amendments, revisions and replacements will be effective immediately upon posting through the updated Terms and Conditions, unless a later effective date is specified. Continued use of the Sailors Loyalty Program by the Member following such notification represents your agreement to be bound by the terms of this document as amended, revised or replaced, and your understanding and acceptance of the amended, revised or replaced document.

    9.3 Spirit of Tasmania will notify the Member of any modification, deletion or amendment to the Sailors Loyalty Program by email or adding the information on the Website.
  1. Limitation of Liability

    10.1 The Member acknowledges and agrees that it uses the Sailors Loyalty Program at its own risk. To the fullest extent permitted by applicable law, Spirit of Tasmania does not accept liability for any claims or losses arising directly or indirectly from:

    (a) any suspension or discontinuance of the Sailors Loyalty Program, or any part thereof; or

    (b) any use of the Sailors Loyalty Program by other members, including any use of the Benefits or Travel Rewards by other users in a manner which contravenes these Terms and Conditions; and

    (b) any failure by a Member to notify Spirit of Tasmania of any changes in accordance with clause 6.4 or for any incorrect changes notified to Spirit of Tasmania.

    10.2 In no event shall Spirit of Tasmania be liable for any damages whatsoever (including any special, indirect or consequential damages) resulting from loss of use, data or profits, whether in an action of contract, negligence or other tortious action, arising out of or in connection with the use or performance of information available from the Website.

    10.3 Notwithstanding clause 6.2, the Member is solely responsible for ensuring that their Member Number, password and other personal information are kept secure and not disclosed to any third parties. Spirit of Tasmania is not responsible for:

    (a) access to a Member Profile by a third party where that third party has used information disclosed or made available by the Member; or

    (b) creation of a Member Profile where a Member provides an incorrect email address.

  1. Privacy

    11.1 Spirit of Tasmania shall comply with the terms of its Privacy Policy in respect of the Sailors Loyalty Program, which are incorporated into, and form part of, these Terms and Conditions.

    11.2 The Member agrees that Spirit of Tasmania may collect and use technical data and related information, including technical information about Qualified Bookings, Benefits, Travel Rewards and other tendencies identified through the Sailors Loyalty Program which are gathered periodically. In addition to any other rights it may have to use this information pursuant to its Privacy Policy, Spirit of Tasmania may use this information, as long as it is in a form that does not personally identify the Member, to improve its products or to provide services or technologies to the Member.
