INTRODUCTION
1.1 Spirit of Tasmania's
online Loyalty Program ("Loyalty Program"), located at
www.spiritoftasmania.com.au/loyalty-program (the "Site"), is
operated by TT-Line Company Pty Ltd (trading as Spirit of Tasmania)
ABN 39 061 996 174 ("Spirit of Tasmania").
1.2 Information on access,
eligibility and entitlements of the Loyalty Program form part of
these Terms and Conditions ("Terms and Conditions"). These Terms
and Conditions form the basis of the Loyalty Program. They are
intended to protect both the member ("Member") and Spirit of
Tasmania. It is the Member's responsibility to read and understand
them.
1.3 These Terms and Conditions
are effective from 1 April 2011 and may be amended by Spirit of
Tasmania at any time.
1.4 Members of the Loyalty
Program are bound by these Terms and Conditions.
2.
ACKNOWLEDGMENT
2.1 You acknowledge that as
a Member of the Loyalty Program:
- You must be 16 years of age or older
- You are an Australian permanent resident.
- You understand that it is an online program only, and you must
register a valid email address to receive Benefits.
- You agree to receive Benefits, acknowledging that you can
"opt-out" of receiving information, special offers and benefits at
any time.
- You have no objection with Spirit of Tasmania using the
information you provide when signing up to determine what Benefits
you receive.
- You understand that unless otherwise stated, passengers who do
not qualify and sign up to the Loyalty Program are not eligible for
the Benefits.
- You understand that only one email address can be registered
per person.
- You understand and accept that Spirit of Tasmania may track
your use of the Site and may freely use and disclose any
information and materials received from you or collected through
your use of the Loyalty Program or the Site for any lawful reason
or purpose, in accordance with the guidelines set forth in its
Privacy Policy.
3.
MEMBERSHIP
3.1 There are two Membership
levels in the Loyalty Program. The entry level is the Sailors Club.
Members may progress to the next level; Frequent Travellers Club,
by completing the minimum travel requirements outlined in clause
6.1.
3.2 As a Member of the Loyalty
Program, you will receive information, special offers and benefits
("Benefits") from Spirit of Tasmania by web, email, mail, mobile
and/or other forms of communication.
3.3 Membership to the Loyalty
Program is only open to individuals. Membership is not open to
families, groups, companies, trusts, partnerships, other entities,
government departments, agencies or animals.
3.4 Passengers ("Passengers")
wishing to become a Member must meet the requirements as outlined
in clause 5.1 and 6.1. Spirit of Tasmania has the right to accept
or reject any Member application.
3.5 Qualified Members will be
assigned with a member number and required to set a password. The
Member's personal information including their member number,
password, full name, date of birth, postal address, mobile, email
address and/or recent travel details, will be used by securely
stored by Spirit of Tasmania. It is the Member's responsibility to
ensure that their member number, password and other personal
information are kept secure.
3.6 Member's personal
information may be used to determine their eligibility for
Benefits.
3.7 Members must advise Spirit
of Tasmania of any change of name, address, or other details as
soon as practicable after the change. Changes to the Member's
mailing address, mobile, password or email address can be made
directly via My Details at the Site or by calling or e-mailing the
Spirit of Tasmania's Customer Contact Centre. You must supply your
member number and personal information when making any such
changes. Written proof may need to be supplied for any change of
name, and may be required for other changes. Spirit of Tasmania is
not responsible for any failure by a Member to notify Spirit of
Tasmania of any changes in accordance with this clause, or for any
incorrect changes notified to Spirit of Tasmania.
3.8 Members may, at any time,
cancel their membership by the opt-out available on the Site or
emails. Spirit of Tasmania will cancel the relevant membership and
all accumulated Benefits in that Member's account will be
forfeited. Accordingly, Spirit of Tasmania recommends that Members
carefully plan all cancellations to avoid unintentional loss of
Benefits.
4.
REGISTRATION
4.1 The Member shall provide
current, complete, and accurate information in the sign up section
of the Site. The Member shall further update and keep such
information accurate over time. The Member must be 16 years of age
or older to participate in the Loyalty Program. The Member is
solely responsible for maintaining the confidentiality of the
Member's account information. The Member shall immediately notify
Spirit of Tasmania of any unauthorised account activity, or any
unauthorised use or any other breach of security known to the
Member.
5. TERMS AND
CONDITIONS FOR SAILORS CLUB
5.1 To qualify for the
Sailors Club, Passengers must book a return journey, where their
forward and return sailing is made at the one time, and forward and
return sailing has the same booking number. This is considered a
qualified booking ("Qualified Booking"). The Qualified Booking will
not be added to the member's travel history.
5.2 Discounted or
complimentary travel booked by Spirit of Tasmania for employees,
suppliers, providers, including but not limited to industry and
trade partners are not considered as a Qualified Bookings,
therefore they are ineligible for the Loyalty Program.
5.3 Qualified Bookings can be
booked online via www.spiritoftasmania.com.au, via Spirit of
Tasmania's Customer Contact Centre/Terminal Front Counters, or via
an authorised travel agent.
5.4 Passengers that make a
Qualified Booking online will receive an invitation to the Sailors
Club; the invitation will appear on the booking confirmation page
of the website.
5.5 Passengers that make a
Qualified Booking via Spirit of Tasmania's Customer Contact
Centre/Terminal Front Counters or via an authorised travel agent
will receive an email invitation within one hour of finalising the
payment on their booking. The email invitation will be sent to the
lead passenger whose email address is registered in the
booking.
5.6 Passengers who make a
Qualified Booking and do not receive an invitation to join the
Sailors Club can sign up on the Site by entering the booking number
of their Qualified Booking and their first name and last
name.
5.7 Members of the Sailors
Club are entitled to the following benefits;
- Access to their own Member webpage on the Site
- Regular emails informing Members of information, competitions,
special offers and exclusive discounts.
- Special rewards when Members book and travel Spirit of Tasmania
journeys.
- Special offer on Member's birthday
5.8 The Sailors Club Benefits
are available under 'My Options' in the members section of the
Site. Terms and conditions for each Benefit are published
separately on the Site and are available only at the time of
promotion. All discounts only apply to new bookings made since
becoming a member.
6. TERMS AND
CONDITIONS FOR FREQUENT TRAVELLERS CLUB
6.1 To qualify for the
Frequent Travellers Club, Members must complete twelve (12)
journeys; six return, twelve one-way or a mixture of both, within a
twelve month period.
6.2 Passengers that are
Members of the Sailors Club and meet the minimum travel
requirements as outlined in clause 6.1 will automatically be
upgraded to Frequent Traveller status. Members will receive an
email notifying them of their upgrade and new Frequent Traveller
Benefits.
6.3 Passengers that are not
Members of the Sailors Club and meet the minimum travel
requirements as outlined in clause 6.1 can register for the
Frequent Travellers Club by completing the form available on the
Site. Applications with be reviewed by Spirit of Tasmania and
passengers will be informed by email if their application was/was
not successful. Successful applicants will be assigned with a
member number and required to set a password for online access to
the Member section of the Site.
6.4 Members of the Frequent
Travellers Club are entitled to the following benefits;
- Access to their own Member webpage on the Site.
- Regular emails informing Members of information, competitions,
special offers and exclusive discounts.
- Special rewards when Members book and travel Spirit of Tasmania
journeys.
- Special offer on Member's birthday.
- Exclusive year round discount for Frequent Traveller
Members.
- Free exclusive cabin occupancy when Member is travelling alone
in a cabin.
- Access to pre-book a table for Spirit of Tasmania's on board a
la carte restaurant.
6.5 The Frequent Travellers
Club Benefits are available under 'My Options' in the members
section of the Site. Terms and conditions for each Benefit are
published separately on the Site and are available only at the time
of promotion. All discounts only apply to new bookings made since
becoming a member.
7. MODIFICATION
TO LOYALTY PROGRAM PROVIDED
7.1 The Member acknowledges
and agrees that Spirit of Tasmania may, with or without notice,
modify, delete, or amend the Loyalty Program, Benefits and/or the
Site provided hereunder. Spirit of Tasmania will notify the Member
of any modification, deletion or amendment to the Loyalty Program
by email or adding the information on the Site.
8. INACTIVE
MEMBER ACCOUNTS
8.1 Spirit of Tasmania has
the right to close a Member's Loyalty Program account if the
Member's account has remained inactive for a period of 12 months
and/or if the Member hasn't booked a journey with Spirit of
Tasmania in five years. The Member shall not be compensated or
reimbursed for Benefits lost as a result of an account that has
closed due to inactivity.
